U.S. District Court Judge Thomas Thrash Jr., who was appointed by President Bill Clinton, had ruled that the Fearless Fund’s grant program is a form of protected speech under the First Amendment. The juvenile court judge denied the claim by the child’s GAL that a ten-year-old child could not assert the psychotherapist-patient privilege on their own. The GAL contended that it could waive the privilege on the child’s behalf in its efforts to pursue a termination of the child’s parents’ legal rights.

The GAL appealed this ruling, and the clinic appeared in the appeal to present policy arguments about how compelled testimonial disclosure, like any other breach of confidentiality, disrupts the psychotherapist-patient relationship and can fatally impair the therapeutic process, even when the appeal involves a younger child. The National Venture Capital Association, an trade group with hundreds of member VC firms, filed an amicus brief defending the Fearless Fund’s grant program as “modest but important” step to toward creating equal opportunity in an industry that has historically excluded Black women. The judge offered few hints about how he would rule, although there was some implicit criticism of state leaders for waiting so long to challenge the SAVE plan, given that the Biden administration first unveiled the program more than six months ago. Such a delay could undercut the argument that they face imminent harm as a result of SAVE’s student loan forgiveness benefits. When individuals and families are safely housed, they’re much more likely to address their health, addictions, and other issues. It’s a “housing first” approach that includes stabilization services, emergency shelter, transitional and permanent housing, and case management. Meanwhile, a federal court in Missouri is also considering whether or not to impose a preliminary injunction to block SAVE. A different coalition of states led by Missouri filed a separate lawsuit against the Biden administration in that jurisdiction. Missouri is the same state that spearheaded the legal challenge to Biden’s first student loan forgiveness plan ultimately struck down by the Supreme Court nearly a year ago. The court ordered the Fearless Fund to suspend its Strivers Grant Contest, which provides $20,000 to businesses that are majority owned by Black women, for the remainder of the lawsuit that is being litigated in a federal court in Atlanta.

“Their standing theory is weaker than the one that prevailed in Biden v. Nebraska,” wrote the judge, referencing the 2023 Supreme Court decision that struck down Biden’s first mass student debt relief plan. Boston receives more than $47 million to support the City and its partners to provide housing and services to individuals and households experiencing homelessness. Coincidentally, the Biden administration extended a key consolidation deadline for the IDR Account Adjustment to June 30. The psychotherapist-patient privilege is a legal safeguard that shields private disclosures made by a patient to a therapist from being accessed by other parties without the patient’s consent. They want to know that there are people out there who care, who won’t treat them “like they’re trash,” Rivera said. Coping with those deaths, and the prospect that she will likely see more as the state and country continue to grapple with the overdose crisis, Rivera said she relies on belief — and the knowledge that change doesn’t happen overnight. “It’s happening a lot,” Rivera said, emphasizing that there are more dangerous substances being put in the drugs being consumed on the street.
